GRANTS FOR WORKING CAPITAL

FINANCIAL SUPPORT FROM NON-REFUNDABLE EXTERNAL FUNDS RELATED TO THE 2014-2020 COMPETITIVENESS OPERATIONAL PROGRAM, CONTINUED AS POC, IN THE CONTEXT OF THE CRISIS CAUSED BY COVID-19, WHOSE ACTIVITY HAS BEEN PROHIBITED BY MILITARY ORDINANCES DURING THE STATE OF EMERGENCY OR RESTRICTED DURING THE STATE OF ALERT.

FUNDING

For SMEs with turnover for the year 2019 ranging between 5.000 and 33.350 euros, the grant amount is 5.000 euros, or 24.739 lei;

For SMEs with turnover for the year 2019 exceeding 33.350 euros, the grant amount is 15% of the turnover and cannot exceed the sum of 120.000 euros, or 593.748 lei.

BENEFICIARIES

They were not in difficulty as of December 31, 2019;

They have recorded operational profit from current activity (from operating activity) in one of the last two financial years;

They have co-financing amounting to a minimum of 15% of the grant value.

OBLIGATIONS

Retention of jobs for at least 6 months;

Acquired assets must be new;

Maintaining activity for at least 6 months.

ELIGIBLE EXPENSES

 Raw materials, materials, goods;

 Rental expenses;

 Medical equipment, disinfection materials;

 Equipment, machinery, technologies, independent endowment.

 

FINANCING

The value of the working capital support is established as follows:

a) for SMEs with turnover for the year 2019 between 5,000 and 33,350 euros, the grant amount is 5,000 euros, respectively 24,739 lei;

b) for SMEs with turnover for the year 2019 exceeding 33,350 euros, the grant amount is a percentage of 15% of the turnover and cannot exceed the amount of 120,000 euros, respectively 593,748 lei.

ELIGIBLE BENEFICIARIES

Grants are awarded based on a state aid granting contract concluded with the following categories of beneficiaries: SMEs, agricultural companies, agricultural cooperatives, producer groups and organizations from the agricultural, fishery, and aquaculture sectors, the food industry, and other related activities, whose current activity has been affected by the effects of the COVID-19 pandemic. For registration on the electronic platform, applicants must be registered with the Unique Identification Code/Tax Identification Certificate at ANAF. The list of eligible activity sectors is provided in the annex to Government Emergency Ordinance no. 61 of May 6, 2022, regarding some measures for granting microgrants and working capital grants to entities in the agri-food sector with non-repayable external funding.

Working capital grants are awarded to beneficiaries who cumulatively meet the following conditions:

a) they have recorded operational profit from current/operational activity or exploitation activity in one of the last three financial years before submitting the grant application, according to the financial statements submitted to ANAF;

b) they have co-participation in the establishment of working capital in the percentage of 15% of the grant value, at the time of granting the working capital grant, co-financing which is free from state aid, according to the current legal provisions;

c) they maintain or, where appropriate, increase the number of employees, compared to the date of submission of the application (The Employee Registry from Revisal to be uploaded to the electronic application must contain active, suspended, and terminated employees and must be issued on the day before the submission of the funding application for a period of at least 6 months from the date of granting the grants, with the exception of situations where individual employment contracts are concluded for seasonal or daily workers; The number of employees to be maintained includes active and suspended employment contracts concluded for an indefinite period.

d) The CAEN REV 2 code for which state aid is requested was authorized according to the legal provisions in force on December 31, 2019.

e) they were not in difficulty on December 31, 2019, within the meaning of the provisions of art. 2 pt. 18 of Regulation (EU) No 651/2014 of the Commission of June 17, 2014, declaring certain categories of aid compatible with the internal market in application of articles 107 and 108 of the Treaty, as amended and supplemented by Regulation (EU) No 1084/2017, of Block Exemption Regulations in the agriculture sector (ABER) and Block Exemption Regulation in the fisheries and aquaculture sector (FIBER).

f) the total amount of state aid received under the temporary COVID-19 scheme established by the European Commission, together with the amount of state aid requested under this measure, falls within the ceilings mentioned in the Temporary COVID-19 Framework, namely 345,000 euros for each enterprise operating in the fishing and aquaculture sector, 290,000 euros for each enterprise operating in the primary production of agricultural products sector, and 2,300,000 euros for each enterprise operating in other sectors.

g) there are no decisions against them for the recovery of state aid that have not been fully executed and recovered in accordance with the current legal provisions.

h) they are not subject to preventive concordat, liquidation procedures, insolvency or bankruptcy.

i) they have not applied for state aid under measure 1 – microgrants granted from non-repayable external funds in lump sum form, as defined in Government Emergency Ordinance no. 61 of May 6, 2022, regarding some measures for granting microgrants and working capital grants to entities in the agri-food sector with non-repayable external funding.

j) they have less than 250 employees and an annual net turnover equivalent to 50 million euros or total assets equivalent to 43 million euros.

k) they had a turnover of at least 24,739 lei in 2019.

The verification of the beneficiary’s classification as an SME is carried out, on a sample basis, by MAT/AIMMAIPE after the submission of the funding application and the conclusion of the state aid granting contracts, provided that the support is recovered from non-repayable external funds if the beneficiary does not fall within the eligible beneficiaries category at the time of submitting the funding application.

FINANCIAL AID TYPES

Through this measure, funding applications are financed in the order of their submission, under the following conditions:

a) for SMEs with turnover for the year 2019 between 5,000 and 33,350 euros, the grant amount is 5,000 euros, respectively 24,739 lei;

b) for SMEs with turnover for the year 2019 exceeding 33,350 euros, the grant amount is a percentage of 15% of the turnover and cannot exceed the amount of 120,000 euros, respectively 593,748 lei.

c) The value of working capital grants does not include the co-financing of state aid beneficiaries, which must be free of state aid, in the percentage of 15% of the requested grant value.

(1) Beneficiaries may use working capital grants, in lump sum form, allocated from non-repayable external funds, co-financed from the state budget, based on a state aid granting contract concluded electronically, to support the following expenses incurred after February 1, 2020:

a) expenses related to stocks of raw materials, materials, goods, and other categories of stocks necessary for the current/operational activities carried out by beneficiaries;

b) current and overdue debts to current suppliers, including utilities suppliers, according to the contracts concluded;

c) expenses related to rent based on a concluded contract and/or expenses related to leasing or royalties based on a lease contract or concession contract for agricultural land;

d) expenses related to the purchase of services necessary for current/operational activities, except consultancy services;

e) expenses related to the purchase of inventory items, including inventory items of fixed assets necessary for resuming current/operational activities;

f) expenses related to the purchase of equipment, machinery, installations, and technologies necessary for resuming current/operational activities;

g) expenses related to the payment of debts to the state budget and local budgets.

(2) The expenses incurred from working capital grants, as mentioned above, must be related to the activities/sub-activities of the CAEN code for which funding has been requested and must be incurred no earlier than February 1, 2020 and for a period not exceeding 180 days from the date of receipt of the grant.

(3) The verification of the assurance of eligible expense types is carried out by MAT/AIMMAIPE and AM POC on a 1% sample for the validation of the lump sum.

(4) Beneficiaries shall submit a declaration on their own responsibility that the use of the grant for purposes other than those provided for in Government Emergency Ordinance no. 61 of May 6, 2022, will result in the recovery of the granted state aid, together with the payment of accessories.

(5) VAT expenses are eligible if unrecoverable.

(6) For the settlement of debts, invoices issued before the signing of the contract are also eligible, which will be paid from the microgrant granted under the measure, after the signing of the state aid granting contract. Outstanding debts related to taxes and payroll taxes incurred after February 1, 2020, are eligible.

(7) Consultancy expenses are not eligible under this measure.

(8) Net salary expenses, second-hand goods purchases, purchases in leasing system are not eligible, and expenses related to the rent of tangible assets are not eligible, except for expenses related to rent based on a concluded contract, for the registered office/branch where the activity for which funding is requested is carried out.

(9) With the exception of point (7), expenses related to rent based on a concluded contract for the registered office/branch where the activity for which funding is requested is carried out are eligible.

(10) Within this measure, the following categories of expenses are not eligible to be reimbursed from state aid: land, constructed land, buildings, means of transport, repayments and/or repayments on loans/credit lines/leasing, related interest, any kind of guarantees, co-financing within other forms of support.
