FUNDING:
- Non-Repayable Financial Allocation – maximum 200,000 lei/beneficiary, an amount that can represent 100% of the eligible expenses (including VAT for non-paying companies) related to the project.
Eligible expenses: workspaces, utility vehicles, equipment, machinery, computers, furniture, website, software licenses, courses, consultancy, etc.
ELIGIBLE BENEFICIARIES
Companies (micro-enterprises, small and medium-sized enterprises) can benefit from the provisions of the Program if they cumulatively meet the following eligibility criteria at the time of completing the business plan:
a) Beneficiary enterprises are enterprises established by natural persons under the provisions of Law no. 31/1990 on companies, republished, with subsequent amendments and completions, Emergency Government Ordinance no. 6/2011 on the stimulation of establishment and development of micro-enterprises by novice entrepreneurs, approved with modifications through Law no. 301/2011, with subsequent amendments and completions, or Law no. 1/2005 on the organization and functioning of cooperatives, republished, with subsequent amendments, with a maximum of 3 years before the date of completion and online transmission of the business plan and which meet, at the time of submission of the financing application, the eligibility criteria imposed by the legislation in the field of de minimis aid and the eligibility conditions provided in the de minimis aid scheme to be approved in accordance with art. 5.
b) Beneficiary enterprises are enterprises established after the date provided for in paragraph (1) by natural persons who have not had or have not had the quality of shareholder or associate in another small or medium-sized enterprise that carries out or has carried out the same authorized activity for which they apply under the program in the year prior to registration or in the year of registration until the opening of the registration session.
c) they are SMEs, according to the provisions of art. 2 and art. 4 para. (1) lit. a), b) or c) of Law no. 346/2004 on the stimulation of establishment and development of small and medium-sized enterprises, with subsequent amendments and completions, which transpose into national legislation Recommendation EC no. 361 of 6 May 2003, published in the Official Journal of the EU no. L124 of 20 May 2003 (they have up to 249 employees and achieve an annual net turnover of up to 50 million euros or own total assets of up to 43 million euros, equivalent in lei).
d) they are considered autonomous, related, partner or unique enterprises;
e) they have fully private share capital;
f) associations or shareholders holding several companies can apply under this program only with one company;
g) they are registered with the Trade Registry Office, have their registered office/place of business and carry out their activity in Romania;
h) the CAEN code for which funding is requested is eligible under the Program and authorized until the payment of the last reimbursement/request, according to art. 15 of Law 359/2004 on simplifying the formalities for registering natural persons, family associations and legal entities in the Trade Registry, their tax registration, as well as the authorization of legal entities, with subsequent amendments and completions. The funding request is made for a single CAEN code;
i) they have no debts to the consolidated general budget and to the local budgets, both for the registered office and for all work points, at the date of signing the financing agreement, hereinafter referred to as the financing agreement; Applicants with staggered debts are not eligible to access the Program.
j) they have not exceeded the de minimis ceiling of EUR 200,000.00 over three consecutive financial years for a unique enterprise, as defined by Commission Regulation (EU) No 1407/2013 of 18 December 2013 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid and EUR 100,000 over three financial years for beneficiaries carrying out freight transport activities on behalf of third parties or for a fee. The ceilings apply regardless of the form of de minimis aid or the objective pursued and regardless of whether the aid is granted from state budget funds or community funds.
k) they are not in a state of dissolution, judicial reorganization, liquidation, forced execution, operational closure, insolvency, bankruptcy or temporary suspension of activity;
l) they have not been the subject of a decision issued by the European Commission / AIMMAIPE / other state aid provider/Competition Council, to recover a state/de minimis aid, or, if they have been the subject of such a decision, it has already been executed and the debt fully recovered, with penalties;
m) they create at least one full-time job for an indefinite period after the entry into force of the financing agreement and maintain the job occupied, in the project implementation location, for at least 2 years after the completion of the project implementation; In case the job/jobs created under the scheme become vacant for various reasons, or are suspended, after their creation under the scheme, the beneficiary has a maximum of 30 days to fill the vacant job/jobs, maintaining their number and type for which they received points in the business plan. Changes in the type of jobs are allowed during the reporting period between unemployed, graduate after 2012 or disadvantaged person defined according to the legislation.
TYPES OF FINANCIAL AID
The Program finances the implementation of Business Plans, in descending order of scores obtained, under the following conditions:
– Non-Repayable Financial Allocation – maximum 200,000 lei/beneficiary, an amount that can represent 100% of the eligible expenses (including VAT for non-paying companies) related to the project.
The object of the funding must fall within one or more of the following eligible categories:
a) Technological equipment, including IT equipment such as PC computing equipment, consisting of: central unit, server, monitor, printer/copier/multifunctional, including portable systems, licenses necessary for carrying out the activity, audio-video systems, with the exception of mechanical, electrical, electronic gambling, billiards tables, jukeboxes, gaming machines. By technological equipment, according to the scoring grid, all goods described in groups 2.1, 2.2. and 2.3.6. from H.G. 2139/2004 for the approval of the Catalogue regarding the classification and normal operating lives of fixed assets, or inventory items assimilated to the mentioned groups. In the category of equipment for which additional points are obtained, the following are assimilated: fixed assets and inventory items for playgrounds and sports halls, fitness, x-body and strength training, drones, artificial sports grounds.
b) Acquisition of workspaces, production spaces and spaces for services and trade. The value of the asset to be purchased under the program will be based on an assessment by an ANEVAR expert evaluator, except for mobile work/production/service/trade spaces. The assets in this category must not have a residential destination at the time of acquisition. Tents for organizing events and pressure balloons are included in the category of workspaces. If the beneficiary wants to purchase workspaces that have residential destinations, they must be converted into non-residential destinations within 6 months of signing the financing contract.
c) Vehicle, land, and water transport equipment, with the exception of leisure boats.
d) Furniture, to the extent that it is included in the value of the real estate for which financing is requested.
e) License for computer software and payment for implementation services for the application, other software applications in the category of intangible assets, according to HG 2139/2004, except for software licenses for cryptocurrency mining/storage.
f) Creation and implementation of a web page for presentation and promotion of the company and/or its products/services.
g) In the case of business plans submitted by small and medium-sized enterprises, at least 50% of the requested non-repayable financial allocation will be allocated for the acquisition of technological equipment, vehicles, and real estate for which financing is requested.
IMPORTANT!
- Systems for cryptocurrency mining/storage, tablets, and mobile phones are not financed.
- Activities such as astrology, spiritism, escort services, matrimonial agencies, etc., are not financed.
- The social headquarters and implementation locations must be in the type of locality for which they have opted.
- Advances and lump sums can be granted under certain conditions.
- Beneficiaries must prove the commitment and maintenance of at least one job for a minimum of 2 years after the completion of the project.
